Terms of Use

What Paranoia is, what a score means and does not mean, and the terms you agree to by using the app or this site.

DRAFT

Review by a human before launch. This page is published for completeness and its wording may change.

ACCEPTANCE

These terms govern your use of the Paranoia app and this website, together the service. By downloading the app, subscribing, or using this site, you agree to them. If you do not agree, do not use the service.

“We” and “us” mean Diego Fill, who publishes the app and operates this site. “You” means the person using it.

How we handle data is a separate document: the Privacy Policy.

EDITORIAL OPINION

Every score is our editorial opinion, not a legal or regulatory finding.

Scores are produced by a published, weighted rubric applied to public, cited sources. The rubric and its weightings are readable inside the app, so you can see how a number was reached and disagree with it on the merits rather than guessing at it.

A score is not an accusation of illegality, a certification, an audit, a regulatory finding or advice. It is our assessment of publicly available evidence, and reasonable people can weigh that evidence differently.

ACCURACY AND CORRECTIONS

We work from public sources, and public sources go stale. A policy changes, a scan is run on a different day, a company restructures. We do not warrant that every score, claim or citation is current, complete or free of error, and we may update, re-weight or withdraw any score at any time as the evidence changes.

If something is wrong, tell us. Email partnerships@diegofill.com with the company, the specific claim, the source we cited and what is wrong with it.

We read every report. We check the claim against its source, correct or withdraw it if the report is right, and reply either way. Corrections are made in the dataset the app syncs, so a fix reaches every reader. Full instructions are on the support page.

NOMINATIVE USE

Company names, product names, logos and trademarks that appear in the service belong to their respective owners and are used nominatively — to identify the company or product being described, which is the only way to write about them at all.

No affiliation, sponsorship, endorsement or approval by any company we score is claimed or implied. No scored company reviews, approves or pays for its entry.

SOURCES AND LICENCES

Every score rests on public sources. These are the four, with the licence each is published under and the obligation that licence puts on us:

  • ToS;DR CC BY-SA. Attribution plus share-alike: any dataset we redistribute that is derived from it carries the same licence. We credit it here, in the app, and beside every claim it supports.
  • PrivacySpy CC BY. Attribution. We credit it here, in the app, and beside every claim it supports.
  • Wikidata CC0. None — a public-domain dedication imposes no condition. We credit it anyway, because a claim you cannot trace is a claim you cannot check.
  • Blacklight (self-run scans) . Not a licensed dataset: we run the scans ourselves with The Markup’s published tool and report our own results, crediting the tool and its authors.

Never a purchased or scraped dataset.

PARANOIA PLUS

Paranoia Plus is an optional auto-renewable subscription at $47.00/year, with a 3-day free trial. It unlocks the personalised rankings, recommended alternatives and watchlist alerts described on the App Store listing. The rest of the app stays free.

Payment is charged to your Apple ID; the subscription renews automatically unless cancelled at least 24 hours before the current period ends, and can be managed in your Apple ID subscription settings.

The subscription is managed and cancelled by you, in your Apple ID subscription settings. Cancelling stops the next renewal and leaves your access running to the end of the period you have already paid for.

Apple is the merchant of record, so refunds are requested from Apple, not from us. Apple’s instructions are here: Request a refund for apps or content you bought from Apple; the request itself is made at reportaproblem.apple.com.

To be plain about the limits of what we can do: we cannot cancel your subscription for you and we cannot issue you a refund. Both live entirely in your Apple account, and we have no access to it.

ACCEPTABLE USE

Use the service to look things up. Do not scrape, crawl, bulk-download, mirror or redistribute the scored dataset, the rubric or the citations, whether by hand or by tool, and do not use them to build or train a competing dataset or model.

Do not attempt to interfere with the service, circumvent a paywall or trial limit, reverse-engineer the app except where that right cannot lawfully be excluded, or use the service to harass a company or a person. Quoting a score with attribution and a link is fine and always has been — that is what publishing it is for.

INTELLECTUAL PROPERTY

The scores, the rubric and its weightings, the written assessments, the app, this site, and the Paranoia name and visual identity are ours and are protected by copyright and trademark law. Nothing in these terms transfers any of it to you.

You get a personal, non-exclusive, non-transferable, revocable licence to use the service for your own purposes, and nothing more. The underlying source material stays under its own licence, listed above.

DISCLAIMER OF WARRANTIES

The service is provided as is and as available, without warranty of any kind. To the fullest extent permitted by law we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted availability.

We do not warrant that any score is accurate, current or complete, that the service will be available or error-free, or that it will meet your requirements. Decisions you make on the basis of a score are yours.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this clause may not apply to you.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or exemplary damages, or for any loss of profits, data, goodwill or business opportunity, arising out of or in connection with the service, whether or not we were advised of the possibility.

Our total liability for all claims arising out of or relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or twenty-five United States dollars.

You agree to indemnify and hold us harmless against any claim, loss or expense, including reasonable legal fees, arising from your use of the service or your breach of these terms.

Some jurisdictions do not allow these limitations, so parts of this clause may not apply to you. Nothing here limits liability that cannot lawfully be limited.

GOVERNING LAW

These terms are governed by the laws of [Jurisdiction — to be confirmed], without regard to its conflict-of-laws rules, and the courts of that jurisdiction have exclusive jurisdiction over any dispute arising from them.

The square brackets are not a typographical error. This document has not yet had legal review and the jurisdiction has not been settled; naming one we had not decided on would be worse than showing you the gap. Your rights under the mandatory consumer law of your own country or region are unaffected either way.

CHANGES

We may change these terms as the app changes or the law does. When we do, the revised terms are published on this page and the effective date below moves to the date of the change.

Continuing to use the service after that date means you accept the revised terms. If you do not, stop using the service and cancel any subscription through your Apple ID. Because we hold no accounts and no email addresses, this page is the notice.
